MuscleDog®.com’s “Best Abs” Contest Rules and Regulations
THE FOLLOWING RULES AND REGULATIONS APPLY TO ALL MuscleDog.com CONTESTS UNLESS OTHERWISE NOTED OR POSTED ON A GIVEN CONTEST.
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN MuscleDog.com’s “Best Abs” CONTEST: MuscleDog.com’s CONTESTS (the “CONTEST”) are generally sponsored by MuscleDog.com (together with its divisions, affiliates, officers, subsidiaries, agents and employees, MuscleDog.com”), along with various other parties which may provide prize materials or other items to the CONTEST, collectively referred to as “Sponsors” or “Providers”. MuscleDog.com initiates and maintains an ongoing CONTEST schedule and posts entry areas during the period for which entry is available (the “Entry Period”).
1. METHOD OF ENTRY: This CONTEST is open to all MuscleDog.com registered members and MuscleDog.com Fans on Facebook. Once an individual has “Liked” the MuscleDog.com Facebook Fanpage, registered with MuscleDog.com and emailed admin@muscledog.com their abs photo and contact information, they will become an official participant in MuscleDog’s “Best Abs” Contest. The deadline to submit photos / register for this contest is Friday, September 30, 2011 at 12:00:00 AM ET. The CONTEST period will run from Monday, October 3, 2011 to Monday, October 31, 2011 at 12:00:00 AM ET.
All ab photos submitted will be reviewed and uploaded at MuscleDog.com’s Admin’s discretion to MuscleDog.com’s Facebook Fanpage photo gallery on October 3, 2011. The one male and one female photo that receives the most Facebook “Likes” in MuscleDog’s Facebook Fanpage photo gallery throughout the CONTEST period will win. It is each participant’s responsibility to share this / promote with their friends in order for optimal chances of receiving the most “Likes” on their specific ab photo in MuscleDog.com’s official Fanpage photo gallery.
On Tuesday, November 1, 2011 by 12:00:00 PM ET, one male and one female CONTEST winner will be announced on MuscleDog.com under the MuscleDog Contests category of the Forums, as well as on the MuscleDog.com Facebook Fanpage. It is the responsibility of each CONTEST participant to check the MuscleDog.com Facebook Fanpage and the MuscleDog Contests category of the FORUMS on Tuesday, November 1, 2011 to find out who has won the CONTEST.
Once both winners have been announced in the MuscleDog Contests category of the Forums and on the MuscleDog.com Facebook Fanpage, it becomes the winner’s responsibility to email admin@muscledog.com to confirm winning the CONTEST within 24 hours of the announcement. Failure to do so will result in the MuscleDog Administrators to select an alternative winner. One male and one female winner of this CONTEST will each be awarded an American Express gift card in the amount of $250 and free MuscleDog gear.
2. ELIGIBILITY: This CONTEST is open to MuscleDog.com members and Fans of MuscleDog.com on Facebook. As of the beginning of the Entry Period, all contestants must be a legal resident of one of the 50 United States or DC (the “Eligibility Area”), 18 years of age or older at the date of entry. International submissions are not valid. Employees, officers, directors and agents, their immediate families (parents, children, siblings, spouses) and household members regardless of where they live, or members of the same households (whether related or not) of the CONTEST Sponsors or of any entity providing prizing or promotion for the CONTEST, are not eligible to participate in the CONTEST or to win any prize. VOID OUTSIDE OF THE ELIGIBILITY AREA AND WHERE PROHIBITED OR RESTRICTED BY LAW.
3. PRIZE/ODDS OF WINNING: Grand Prizes and any other available prizes are as noted on each CONTEST and the odds of winning will be dependent on the prizes available for each CONTEST and the number of entries for each. Where a dispute arises about who submitted an online entry, the entry will be deemed submitted by the holder of the e-mail account. The deadline for entry as chosen by MuscleDog.com, in its sole discretion and as may be amended and may be but is not required to be posted, is final.
4. GRAND PRIZE: On Tuesday, November 1, 2011 by 12:00:00 PM ET, one male and one female CONTEST winner will be announced on the MuscleDog.com Facebook Fanpage and MuscleDog.com site’s Forums under “MuscleDog Contests” by MuscleDog’s administrative panel. The selection of the winners will be conducted by MuscleDog.com whose decisions are final and binding on all aspects of all MuscleDog.com CONTESTS. Failure of any winner to respond within 24 hours from such notification referred to above will result in disqualification and the selection of an alternate potential winner. An alternate potential winner will be selected in the event that a prize cannot be awarded to the potential winner previously selected. In the event of non-compliance, an alternate potential winner may be selected.
5. CONDITIONS, DISCLAIMERS, AND LICENSE: By entering this CONTEST, each entrant agrees to be bound by rules posted on MuscleDog.com and these Official Rules and by all decisions of Sponsors (whose decisions are final and binding on all matters relating to the CONTEST), and to comply with all federal, state and local laws and regulations. MuscleDog.com is not endorsed, sponsored by or affiliated with Facebook or American Express. Such terms are registered trademarks of their respective owners. This promotion is conducted exclusively by MuscleDog.com and is subject to participation terms and conditions. Receipt of your item requires compliance with offer terms, including: age and residency requirements; registration with valid email addresses, shipping address and contact phone number. Upon valid completion of all requirements, we will ship your item to your provided shipping address. Unless otherwise indicated, participation eligibility is restricted to MuscleDog.com members who are US residents, 18 and over. The decisions of the CONTEST Providers are final on all matters of fact, interpretation, eligibility, procedure and fulfillment. Entries and other submitted materials become the property of the Sponsors and/or their promotional partner(s) and will not be acknowledged or returned. Neither the CONTEST Providers nor Internet access providers are responsible for incomplete, late, lost, or misdirected entries or for any technical malfunction, human error, lost/delayed data transmission, omission, interruption, deletion, defect, or line failure in connection with any telephone network, computer equipment, software or any combination thereof. Entries are void if unreadable, inaccurate, incomplete, mutilated, tampered with, forged, mechanically reproduced, irregular in any way, or otherwise not in compliance with these Official Rules. The CONTEST Providers make no warranties, and hereby disclaim any and all warranties, express or implied, concerning any prize furnished or made available in connection with the CONTEST. Although Sponsors attempt to ensure the integrity of the CONTEST, the CONTEST Providers are not responsible for the actions of entrants or other individuals in connection with the CONTEST, including entrants’ or other individuals’ attempts to circumvent the Official Rules or otherwise interfere with the administration, security, fairness, integrity, or proper conduct of the CONTEST. The CONTEST Providers are not responsible for injury or damage to entrant’s or to any other person’s computer(s), other equipment, or person(s), related to or resulting from participation in the CONTEST or downloading materials from or using the CONTEST Site. If, for any reason, the CONTEST is not capable of running as planned by reason of damage by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical limitations or failures, strikes, industry conditions, bankruptcy or liquidation, marketplace demands, applicable law, unforeseen obstacles, or any other causes which, in the sole opinion of Sponsors, could corrupt, compromise, undermine, or otherwise affect the administration, security, fairness, integrity, viability, or proper conduct of the CONTEST, Sponsors reserve the right in their sole and absolute discretion to modify these Official Rules and/or to cancel, terminate, modify, or suspend all or any part of the CONTEST, and to select a winner from among all eligible entries received up to (or after, if applicable) the time of such cancellation, termination, modification, or suspension, as applicable. Proof of submitting entry will not be deemed receipt of such entry by the Sponsors.
All taxes (including without limitation Federal, state and local taxes) in connection with the Grand Prize, and the reporting consequence thereof, are the sole responsibility of the Grand Prize
winners. Potential Grand Prize winner (his/her parent/legal guardian if he/she is a resident of a jurisdiction that deems him/her to be a minor) may be required to sign, execute, have notarized, and return an Affidavit of Eligibility, a Liability Release, (where legal) a Publicity Release and any other documentation that Sponsors require (collectively “Affidavit/Release”) within five (5) days after receipt by potential Grand Prize winner or such potential Grand Prize winner may be disqualified and an alternate potential Grand Prize winner may be selected.” Guest (his/her parent/legal guardian if he/she is a resident of a jurisdiction that deems him/her to be a minor) may be required to sign, execute, have notarized, and return a Liability Release, a Publicity Release and any other documentation that Sponsor requires within five (5) days after receipt by potential winner. You are not a winner until your submissions are validated. By entering this CONTEST, unless prohibited by law or Sponsors’ privacy policies, the potential Grand Prize winner consent to use of his/her respective name, voice, photograph and/or likeness
for advertising or publicity purposes for this and similar promotions without compensation, and the potential Grand Prize winner and Guest may be required to provide a signed release acknowledging such consent. Moreover, by entering this CONTEST, unless prohibited by law, the potential Grand Prize winner agrees to grant to the Sponsors, and their respective licensees, affiliates, and assigns, the right to print, publish, broadcast, and use, worldwide in any media now known or hereafter developed, including without limitation the World Wide Web, at any time or times, the prize winners’ respective name, likeness (actual or simulated), voice (actual or simulated), and biographical information as news or information and for advertising and promotional purposes without additional consideration; and further without such additional compensation, appear for, or provide biographical information for use in, any presentation or other activity which may include filming/audio/video/electronic or other recordings and/or interviews, as may be determined from time to time by Sponsors in their sole discretion.
6. (a) Conduct: the official rules will be posted at MuscleDog.com (as may be amended from time to time). By entering and participating in this CONTEST, entrants (a) fully and unconditionally agree to be bound by these official rules and by all decisions of the CONTEST providers (whose decisions shall be final and binding in all respects), including without limitation decisions regarding eligibility, winners and the interpretation of terms used in these official rules; and (b) represent and warrant that all information provided by entrant in connection with the CONTEST is true, accurate and complete. The CONTEST providers reserve the right, at any time and at their sole discretion, to disqualify and/or deem ineligible to participate in this CONTEST or any future CONTEST or other promotions of the CONTEST providers, any individual it suspects: to be tampering with the entry process or the operation of the CONTEST or the CONTEST site; to be acting in violation of the official rules or the CONTEST site’s terms of service, privacy policy or other terms, conditions or guidelines; to be acting in bad faith or in a disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; to have failed to agree to these official rules; or to be in violation of these official rules. Any attempt by an entrant or any other individual to deliberately damage any internet site or undermine the legitimate operation of the CONTEST is a violation of these official rules as well as criminal and civil laws. Should sponsors believe or become aware that such an attempt has been, is being, or will be made, sponsors reserve the right to seek remedies and damages from any responsible entrant(s) and other responsible individual(s) in the attempted damage to the fullest extent permitted by law, including without limitation criminal prosecution.
7. Release and indemnification: by entering the CONTEST, entrants release and hold the CONTEST providers harmless from and against any and all losses, damages, rights, claims, and actions of any kind arising in whole or in part, directly or indirectly, from the CONTEST or participation in any CONTEST-related activity (including without limitation the removal from the site of, or discontinuation of access to, any materials), or resulting directly or indirectly, from acceptance, possession, use, or misuse of any prize awarded in connection with the CONTEST, including without limitation personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy.
8. Limitation of liability: in no event will the CONTEST providers be responsible or liable for any damages or losses of any kind, including without limitation direct, indirect, incidental, consequential, or punitive damages, arising out of any access to and/or use of the CONTEST site, the downloading from and/or printing material downloaded from the CONTEST site, the removal from the CONTEST site of, or discontinuation of access to, any materials, or the acceptance, possession, use, or misuse of, or any harm resulting from the acceptance, possession, use or misuse of, or participation in, any prize awarded in connection with the CONTEST. Without limiting the foregoing, the CONTEST, the prize, and all materials provided on or through the site are provided “as is” without warranty of any kind, either express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. MISCELLANEOUS:
(a) Dates and Deadlines: Because of the unique nature and scope of the CONTEST, Sponsors reserve the right, in addition to those other rights reserved herein, to modify any date(s) or deadline (s) set forth in these Official Rules or otherwise governing the CONTEST.
(b) Privacy: Information submitted in connection with any CONTEST will be treated in accordance with these Official Rules and MuscleDog.com’s Privacy Policy (as may be amended from time to time), currently located at www.MuscleDog.com/privacypolicy.htm; provided, that in the event of any conflict between these Official Rules and such Privacy Policy, the terms and conditions of these Official Rules shall prevail. By entering this CONTEST, you agree that MuscleDog.com may share your personal information with the CONTEST Providers for the purpose of prize fulfillment in the event that you are chosen as a potential winner. Additionally, by opting in to a specific offer by a CONTEST Provider, you agree to receive additional email communications from such CONTEST Provider and your personal information shall be governed by its privacy policy and terms of service.
(c) Severability; Headings: If any provision of these Official Rules is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Official
Rules and shall not affect the validity and enforceability of any remaining provisions. Headings and captions are used in these Official Rules solely for convenience of reference, and shall not be
deemed to affect in any manner the meaning or intent of these Official Rules or any provision hereof.
(d) Rules: These Official Rules shall be posted and available online until the CONTEST has ended and the Grand Prize has been awarded.
